These Terms & Conditions ("Terms") govern your use of the DataX browser extension, website and related services (together, "DataX", "we", "us", "our"), operated by Cyberframe. By creating an account, ticking the "I agree" box, or using DataX, you ("you", "the User") accept these Terms in full. If you do not agree, do not use DataX.

1. What DataX is

DataX is a productivity tool that helps you collect publicly visible business and profile information (such as business name, category, phone, website and a public email) from search-result pages you actively open on platforms including Google, Facebook, Instagram and LinkedIn, and export it to CSV, Excel or Google Sheets. DataX is a neutral tool — you decide what to search for and how to use the results.

2. Eligibility & account

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for keeping your login credentials and license key confidential, and for all activity under your account.
• You may activate the extension on a limited number of devices as stated on your plan; sharing or reselling your license key is not permitted.

3. Your responsibilities & acceptable use

This is the most important part. You alone are the "data controller" / person responsible for any personal data you collect, store or use with DataX. You agree that:

• You will use DataX only for lawful purposes and only to collect information that is already publicly available and that you are legally entitled to access and process.
• You will comply with all applicable data-protection and privacy laws, including (as relevant to you) India's Digital Personal Data Protection Act, 2023 (DPDP Act), the EU/UK GDPR, the CAN-SPAM Act, India's anti-spam / TRAI regulations, the CCPA/CPRA, and any other laws that apply to your collection and use of personal data.
• You will comply with the terms of service, robots and usage policies of every website or platform you access through DataX. You will not use DataX to access content behind a login, paywall or other access control in violation of those terms, or to circumvent any technical protection measure.
• You will obtain any consent required by law before contacting, profiling or marketing to an individual, and you will honour opt-out, unsubscribe and "do-not-contact" requests.
• You will not abuse anyone's privacy. Specifically, you will not use DataX to harass, stalk, dox, defraud, impersonate, discriminate against, or cause harm to any person; to build profiles of sensitive personal data; or to send unlawful spam or unsolicited bulk communications.
• You will keep collected data secure, retain it only as long as lawful, and delete it on request where the law requires.

4. Prohibited uses

You must not, and must not allow anyone else to: (a) use DataX for any illegal, deceptive or harmful purpose; (b) collect special-category / sensitive personal data unlawfully; (c) resell, redistribute or publish personal data in violation of law; (d) attempt to reverse-engineer, decompile, crack, tamper with, or bypass the licensing or security of DataX; (e) overload, disrupt or attack any third-party service; or (f) use DataX in a way that infringes the rights of any third party.

5. Subscriptions, trial & billing

• New accounts receive a 7-day free trial with limited features.
• Paid plans (e.g. monthly and yearly) are billed in advance through our payment processor, Razorpay. Prices are shown at checkout and may change with notice for future renewals.
• Subscriptions auto-renew until cancelled. You may cancel anytime from your account; cancellation stops future renewals, and access continues until the end of the paid period.
• Except where required by law, fees already paid are non-refundable. If your subscription lapses, the extension stops providing paid features.
• We never store your full card details; payments are handled by the processor.

6. Intellectual property

DataX, including its software, branding and content, is owned by Cyberframe and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use DataX for its intended purpose while your subscription is active. You receive no other rights.

7. Disclaimer of warranties

DataX is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that results will be accurate, complete, lawful for your purpose, or that the service will be uninterrupted or error-free. Third-party platforms may change at any time and affect what DataX can collect.

8. Limitation of liability

To the maximum extent permitted by law, Cyberframe and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising from your use of DataX. Our total aggregate liability for any claim is limited to the amount you paid us for DataX in the three (3) months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend and hold harmless Cyberframe, its owners, employees and partners from and against any claims, damages, penalties, liabilities, costs and legal fees arising out of or related to: (a) your use of DataX; (b) the data you collect, store, share or process; or (c) your breach of these Terms or of any applicable law, including any data-protection or privacy law. You are solely responsible for how you use the information you gather.

10. Data we process about you

Our handling of your own account, billing and license data is described in our Privacy Policy, which forms part of these Terms.

11. Suspension & termination

We may suspend or terminate your access, without refund, if we reasonably believe you have breached these Terms or used DataX unlawfully. You may stop using DataX at any time.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "last updated" date. Continued use after changes means you accept the updated Terms.

13. Governing law & jurisdiction

These Terms are governed by the laws of India. You agree to the exclusive jurisdiction of the competent courts in India for any dispute arising out of or relating to DataX.
